the speed limit on friday. state trooper pulled him in yadkinville, 77 in a 65. he didnt have his license on him but knew his # by heart. the trooper slung him out of the car, cuffed him and took him to the magistrate. i guess its cause that guy got shot but shit, hes in college and was just driving up to boone for a friends wedding. was any of that warranted?

yea he has cuff marks on his wrists the cop put them on wrong and didnt listen to him when he told them something wasnt right. my brother is a clean cut guy too, dont get it at all but i think its pretty fucked up

my bro said he told the cop he didnt have his license, and the cop started screaming "WHY WAS IT REVOKED, WHY WAS IT REVOKED" and my brother just left it at the house. he said it took at least 5 minutes to get that straight because the trooper assumed he was driving with a revoked license.innocent until proven guilty my ass. i mean ive heard alot of stories about fucked up cops but now im genuinely fucking pissed because they messed with my brother [Edited on June 22, 2008 at 8:54 PM. with all of the highway patrol misconduct lately, I'm sure his superior officers and maybe Monica Laliberte would love to hear about that. as a side note, my wife has gotten 2 tickets for driving with a license she didn't know was suspended due to the fact that a dismissed ticket was not recorded with the DMV and no notification was sent. The first one was an inspection ticket in Wake co. and the other was a registration ticket in Robeson County. In Wake Co. the clerk admitted the mistake, but not so in Robeson. The suspended license tickets got/will get dismissed, but it still costs a bunch of money and a lot of headache to get the license reinstated.

Actually failure to carry, failure to provide, and not having a license are all the same (they are all misdemeanors). You can charge any misdemeanor on a citation or be taken to the magistrate. Being suspended or revoked is just a stronger misdemeanor (Class 1 instead of 3). yes you can be arrested for failing to carry or provide your license its just up to the cop. They all fall under G.S. 20-7. Driving while revoked is 20-28. There actions are normally based on your actions.

I got a ticket two years ago for speeding and I forgot my license at home. The cop made me call a friend to drive me home leaving the car there... He still cited me for not having the license on me. Another time, I got pulled for illegal tag placement on the bike and again forgot my license, but I was 1/2 mile from my house and had the cop follow me. He checked my license and just gave me a warning.Some days, I just forgot to take my wallet. It's not like it's the end of the world, although I haven't been hassled by cops in 2 years.

Did he have any injury to any muscles or to any of his bones as a result of being arrested?If it's a little nick and a bruise or two you really can't complain that much. If he caused your brother actual bodily injury then you might have reason to file a complaint against the officer, but really the best thing to do is to let it go.
