Lets setup a hypothetical. If you went into a sparring ring with another fighter during MMA workouts and consequently got killed because that fighter beat the life out of you then is it a 100% your fault? You wanted to spar, clearly, or you wouldn't get into the ring. I'm willing to bet though, that you wouldn't have wanted to get killed because your opponent gave into his bloodlust.

One of the reason society has laws is to prevent barbarisms like the one in my extreme scenario, and rape. There's no excuse for any individual losing control and causing immense harm to someone else.

allow me to clarify. in the situation above if there that girl accused an individual of rape and i saw that photograph in conjunction with the statement i made above then i would have to question the truthfulness of her claim.

if it was a random person on the street who got her and she was badly beaten, then i'd be less likely to vote not guilty. however, if it was someone she knew then I could not say "beyond a reasonable dobut" that the accused was guilty and it would thus be my duty to vote not guilty.

I completely agree that most of the time there is one person who is at fault and did something wrong. Whether alcohol was involved or not doesnt matter.
