"Malaika Brooks was driving her son to Seattle's African American Academy in 2004 when she was stopped for doing 32 mph in a school zone. She insisted it was the car in front of her that was speeding, and refused to sign the ticket because she thought she'd be admitting guilt.

Rather than give her the ticket and let her go on her way, the officers decided to arrest her. One reached in, turned off her car and dropped the keys on the floor. Brooks stiffened her arms against the steering wheel and told the officers she was pregnant, but refused to get out, even after they threatened to stun her."

Granted, the woman was stupid for not signing the ticket, but the police officers were equally stupid for trying to arrest her and even more stupid for tasering her.

What's worse is the US District Court supports the officers. Why am I getting the feeling that tasers have made police officers lazier?

^^That's not true...when I got my first speeding ticket I remember signing it...there is a spot that you sign just to show that you got the ticket and then there is a spot that you sign if you just wanna mail in the fine and admit guilt...he told me that the place I was signing was not admiting guilt

Only place i've ever seen to sign on a ticket is for when you just want to mail it in and pay the fine...

[Edited on March 28, 2010 at 4:43 PM. Reason : i've never been asked to sign a ticket when I got it, wtf?]

^^^^not even a little bit. only means that you are acknowledging that the citation was issued and that you have to show up for the court date.

No, I signed my ticket when I got it...I remember cause I was 17 and shaking cause I was so nervous and I appologized to him for my signature being bad. But he said, that I just had to sign to show that I got the ticket, not that I was admiting guilt

I'm sure we can ask theduke though...he's gotten a bunch of tickets

I've had two speeding tickets and didn't have to sign for either one of them to receive them. The second one had a line to sign for admitting guilt if you wanted to mail it in.

The woman was dumb for not signing. But what the cops did was inexcusable. They need their ass beat a few times.

I consider that a good thing (unlike some people)

I've gotten ones for exceeding safe speed, going +15 over, and a failure to yield and was never asked to sign one. Maybe it depends on the county and/or the charge?

I had to sign the ticket when I got it...and then when I went to the lawyer I had to sign it again admiting to guilt...but he dropped it down to improper equipment...

i've only had one speeding ticket but i didn't have to sign a thing. cop said i could mail in the fine or go to court if i wanted to possibly have it dropped

he was probably just terrified of my vicious dogs who were chillin in the passenger seat

you are correct - pigs + tasers = lazy

i see the need for non-lethal, incapacitating weapons, but now every problem is solved with the taser. one would think pigs were incapable of any action before tasers

I think in NC you do not have to sign acknowledging receipt of the ticket. That is pretty stupid to make the cops get them signed anyway, hopefully the officers word would be good enough that he verified id and gave you the ticket.

I wasn't asked to sign the last ticket I got...all the ones prior to that I have been asked to sign. I never have, but they always asked/told me to.

Tasers are only non-lethal until they kill someone, much like gunzz.

"non-lethal" is a bad way to describe a weapon that occasionally kills people.

^ Agreed, but if you call it "less-lethal," which is a more accurate term, I have a feeling it will hurt the marketability to the police force and the acceptance by the population.

^^^ I didn't say anything was wrong with it. I just said that's why they call it "non-lethal," when we all know that the description isn't true. I didn't say I agreed with their stance...

There are plenty of things in this world that are called non-lethal that can still be lethal. It just depends on how often the lethal part happens.

"The majority's opinion outraged Judge Marsha Berzon, who called it "off the wall."

"I fail utterly to comprehend how my colleagues are able to conclude that it was objectively reasonable to use any force against Brooks, let alone three activations of a Taser, in response to such a trivial offense," she wrote.

She argued that under Washington law, the officers had no authority to take Brooks into custody: Failure to sign a traffic infraction is not an arrestable offense, and it's not illegal to resist an unlawful arrest."

figures

Quote :
"Berzon said the majority's notion that Brooks obstructed officers was so far-fetched that even the officers themselves didn't make that legal argument. To obstruct an officer, one must obstruct the officer's official duties, and the officers' only duties in this case were to detain Brooks long enough to identify her, check for warrants, write up the citation and give it to her. Brooks' failure to sign did not interfere with those duties, she said."

just came in here to note that there's no requirement for cops to tell you the truth. don't take their word that signing something isn't admitting guilt. don't sign anything for a cop without a lawyer. period.
