We’re all aware of the recent Duke Student Government Judiciary action regarding allegations made against the Duke College Republicans (DCR). Though the university administration has not previously commented on this issue, we have been paying close attention to it, and have participated in numerous meetings and conversations with various students, organizations and advisers. We have also closely monitored the formal processes to ensure that all parties were treated with fairness and respect.

As we learned yesterday, the DSG Judiciary determined that the evidence was “neither convincing nor conclusive enough to validate the charge” that the student was discriminated against due to his sexual orientation. While one dissenting opinion on the Judiciary claimed there was evidence of a hostile atmosphere in the DCR, we must recognize that the majority ruled otherwise, and concluded that any inappropriate language came from individuals away from any official affiliation with the DCR. However, the finding that DCR as an organization was not guilty of any the allegations made by the student does not excuse the inappropriate language that was directed at the student by certain individuals. Given Duke’s commitment to fostering a learning community where difference is respected, diversity celebrated and inclusion demanded we must also decry hateful language wherever it originates, whether individually or in a group setting.

Duke has a strong tradition of student self-governance, so it is important to note that the primary process for addressing these allegations was through the DSG Judiciary. While there are provisions for individual accountability under the terms of the Duke Community Standard, no one has identified behaviors that warrant judicial action through the Office of Student Conduct. It is also important to point out that speech which may be considered extremely offensive and inappropriate is not in and of itself a violation of Duke policies unless accompanied by specific conduct as defined by our Rules and Regulations.

The thoroughness of the judicial action confirms the wisdom of allowing students to manage this review per the established processes -- processes thoughtfully created by and lead by students. And while the outcome brought closure to the specific nature of the allegations, it does not relieve from the obligation to be vigilant and vocal in condemning situations in which language can be used to harm or disrespect our friends and colleagues. We should be reminded that bias, prejudice and ignorance have not disappeared from our community, and that in times of stress can be harmful, hurtful and disruptive.

Situations such as the one we have just gone through can offer difficult lessons and leave too many victims in its wake. Yet, we must find ways to turn them into educational opportunities. I look forward to further conversations with students, faculty and staff about ways to make this happen.

I hate when people complain about having to read slightly more than a paragraph. You don't have to read it, just don't comment!

I read about this story earlier... there's enough blame to go around amongst all the kids involved. He used club funds to buy some personal stuff, and then got called out on it. At the same time, they found out he's gay.

Could have been handled better? Hell yeah.

Discrimination? Iffy at best.

People at Duke acting like fools? Hell yeah.
