I read this for my masters of public administration.We had to come up with a legal way to either motivate or fire the guy, while assuming he was a public employee.It's actually really hard to fire public employees.

Now that I've found the paper I remember it was about how we would manage the entire situation (including the other employees, who also sucked) from a job analysis and position classification perspective (other groups had other perspectives). And we weren't allowed to fire anyone.I think we came with some stuff like the Lawyer needs to make sure the employee goals line up with the organizational goals, and reclassify the employees' jobs to where they get paid only for the work they do.It was mostly bullcrap because we had to stay within our specific frame of administration.
