Teh wolfmrash makes a good point.Your average POS GPS system purchased at Sam's Club or what have you does not have the capability to transmit shit back to Google or the government or whatever it is that you're afraid of. So what are you afraid of?!?

Use game theory.A) Prosecution has the knowledge that the GPS history is often thereB) Defense has the knowledge that it's thereIt's not scandalous unless you presume that one party knows and chooses to withhold the information, or something like that. Either way, not knowing can screw you. Or you could disable it. Or you could not disable it and set it up so you could make it look like you disabled it...swear to god, I'm not planning on killing someone. It's just so much fun to think about.

uhhh, you're gonna have to have the device out in the open if you want to actually get any signal of any sort. I know it's using radio signals, but most units I've seen won't get a signal under the seat or anything like that. i could be wrong, though

Mine seems to still work closed in the center console and glovebox. Granted, that's just some cheap plastic over it.But you are correct that some elaborate plan to hide one of these totally underneath the driver's seat would likely not work.

I knew my GPS recorded its track and I use that feature to find my way back to the road if I get turned around offroad and use it to help me figure out how close I might be to my previous track (like when trying to get all the way around a fire)

I know this shouldn't piss me off. This is that guy's life. Doesn't have anything to do with me.
