Nurse was 100% in the right. Unless the subject is unconscious with clear evidence of DUI, blood samples require the consent of the subject or a court order. Refusing consent has consequences, of course. Had she performed the procedure she would be guilty of assault and battery.

The "suspect" probably legally refused field testing, so the cop decided he would break the law and force a blood test with no probable cause. I would like to point out that the cop is the only one that broke the law in this instance, and also the only one involved that has not been placed in handcuffs. The nurse and the "suspect" have both been treated like criminals, but the only one that clearly broke the law was the cop.

A lawyer friend of mine has told me that you do not have to take the "field sobriety test either". He said that walking the line and touching your nose and all that stuff only allows them to further build a case against you.

The only test you will be penalized for not taking is the breathalyzer at the station. (this would be post arrest most likely) If you refuse that test you automatically forfeit your license for 12 months, even if you are never charged or convicted, its a DMV regulation, not a criminal offense. The handheld BAC tests you can supposedly refuse, you can refuse to do field tests like walking the line or the eye following thing, you can even refuse to talk anymore after identifying yourself and handing your license over.
