Proof? You think traffic citations require proof?

If an officer says you are speeding, that's all the "evidence" the court will require. If a cop says you were texting, that's also all the "evidence" the court will require.

To adopt a saying from a crazy woman - traffic courts need evidence about as much as a fish needs a bicycle.

apparently you guys don't understand police discretion at all...once you get a ticket for this you're gonna be at the mercy of which ever judge you appear before and how they're feeling that day

i have a feeling they're not going to be lenient at all, at least i hope not

Just heard it on the news about the License Plate frames. Cops are going to only give warnings for a year, and fines won't start until Dec. 2010

No way the license plate frame thing doesn't get struck down by the courts at some point


it's basically a revenue-generating law passed - they'll ticket the fuck out of people at $100 a pop because they know another fucking tax increase would have people rioting in the streets and every single sitting state legislator would lose their re-election bids if they voted for it in this economy.


plus it'll be free money from all the out-of-state drivers who have plate frames, like an automatic gimmie - SHP sees an out of state tag with a frame, pulls em over





actually the more I think about this the angrier I get, and I'm far from tin foil hattery. this bullshit gives police a reason to pull someone over who under other circumstances wouldn't be questioned. It's an unbelievable invasion of privacy and infringement upon the rights of citizens.

If cops want to pull you over, they will pull you over. End of story. I've had cops pull me for saying I touched the yellow line when I know for certain I didn't. I've had cops pull me for increasing my speed from 35 to 38 10 feet in front of a 45 mph sign. A buddy of mine got pulled because the cop said his license place light was flickering on and off even though we spent then next 20 minutes trying to replicate the flicker and couldn't. It's not like this is opening some huge door for cops to jump down your ass for no reason. They already have 100s of those in place already.

I for one have seen half the cars on the road with tag covers/boarders. This will be interesting to see. I'm not going to say this is wrong or eight cause I don't give a shit.

the officer could ask to see your phone and look at the timestamps of the last read or sent messages

also, looking down at all is now reasonable suspicion i would guess

They talked to a Highway Patrol Officer on our local news this morning.

According to the way the law is written, you are allowed to text as long as the vehicle is not in motion. (i.e. stoplight, stop sign, traffic jam, etc etc). Also, they are only giving warning tickets for the first few months to "educate" the public on the law, so it might be a while before ^ happens. Similarly to the way they issued warning tickets for a while after the "change lanes when a cop is on the shoulder" law went into effect.

How strict are the no cell phone laws in NY and other states

I go up there often, but never drive, so I'm curious if there's some leeway, or if you're fucked if they even see you with your phone to your ear

not sure what you're trying to say. if he forced you to show him or forcefully took your phone and looked at it, then that evidence was obtained illegally and wouldn't matter in court anyway.

I heard a story on the radio this morning about some chick who let her BF borrow her phone. He got pulled for texting while driving, the cop asked to see the phone, and saw naked pictures of the chick in the Sent Messages folder. The chick is planning to sue the police deparment.
