Personally I think the story of how the first guy got the phone sounds kind of strange to me. I know that when I worked retail, or just as a person in general, if I ever found something that was lost, the immediate response was to hand it over to the staff. The first place a person is going to go looking for something they lost is wherever they were that day. If you remove it from that place, how are they supposed to find it?

Which leads me to believe the guy really had the intention of stealing the phone and later realized there was something funky with the iPhone.

The team seized several computers, hard drives, digital cameras, cell phones and other gadgets, plus Chen's American Express bill and copies of his checks.

"Are bloggers journalists? I guess we'll find out," Nick Denton, who runs Gawker Media, wrote in an e-mail to The Associated Press.

The phone, speculated to be the next iPhone, was was lost by 27-year-old N.C. State alum Gray Powell who is an engineer working for Apple.

Powell, celebrating his birthday on March, went to German beer house
Gourmet Haus Staudt in Redwood City, Calif., near San Jose and about 20
miles from Apple HQ. Gizmodo says he texted, "I underestimated how good
German beer is" on the test device, which would be the last time he saw
it.

The phone was recovered from a bar stool by another bar patron. It is rumored the device was sold to the blog for $5,000.
