No, it is not always illegal for the mentally handicapped to have sex. The laws differ from jurisdiction to jurisdiction. And, if I am not mistaken, even if a person is legally unable to consent, their guardian can consent for them. There are mentally handicapped individuals who do marry.

It's a fascinating subject.In Europe, it is not unusual for people with physical handicaps to go to Amsterdam to have sex with a sex worker. I watched a program where a paraplegic man from the UK went to Amsterdam once a year for sex. I even believe that the public health care system pays for it because they acknowledge the importance of a person's sexual well being.. I don't see how it would be much different for a mentally handicapped individual. Just because they're delayed or disabled developmentally doesn't mean that their sexuality is nonexistant. Bottombaby made excellent points. I'm a case manager for people with developmental disabilities. Specifically, I serve adults with a DD diagnosis who are also considered sexual offenders because they have either molested children or people who are lower functioning than themselves. Weird job, yeah, but it's incredibly interesting and it's job security because no one else wants to work with these folks.So... that aside, the law goes like this: Once a person turns 18, developmentally disabled or not, they become their own guardian. If a person with DD consents to sex, is over 18, and does not have an appointed guardian, it's legit, the same as if you or I consent. Goes the same for them signing for themselves on legal documents, etc. However, if the person has a court-appointed guardian, they cannot consent for themselves - the guardian would have to make that decision. If the guardian is not present or does not consent to the act, it could be considered a sexual offense. It's actually a really interesting topic because yes, people with developmental disabilities hit puberty normally and develop sexual urges normally. However, with little education for the topic in the DD world, many of these people don't understand what's happening and can get themselves into lots of trouble very quickly, sometimes without realizing it. Many of my clients are not predators the way you would consider your typical pedophile. My clients are adults who believe they are children, but have sexual urges. Recipe for disaster.

Pecky, thanks for the serious input.I'm just a huge advocate of comprehensive sex education for all populations. It's just really important to me.My son is also at high risk for having a borderline IQ because of his diagnosis of DiGeorge Syndrome. It's too soon to tell, but he's currently considered 'developmentally delayed.' Whether or not he catches up to his peers, I intend on acknowledging his sexuality and his sovereignty over his own body. It's important to me to raise a whole child with a healthy sex-positive view.

Knowledge bombs - that's awesome! I know it's a ridiculous thread, but the subject matter is really interesting to me. Bottombaby - so encouraging to hear a mama have an open and honest plan for education, DD or not. So many of my clients' parents were and are in denial and it's the reason some of my guys have to wear a tracking device and register their addresses in the offender registry for the rest of their lives. Not so much a problem with people who have a borderline dx as it is for the mild/moderate MR population, but everyone deserves a proper sex education modified for their intellectual functioning level.
