I've been out of work for 3 weeks on medical leave/ short term disability. Today was my first day back, and they fucking fired me. Said they were changing things and they didn't need me.WTF

7/2/2008 10:58:56 AM
no severance!I need to call a lawyer.I'm being flown down to Raleigh next week for an interview[Edited on July 2, 2008 at 11:00 AM. Reason : yay]
7/2/2008 10:59:50 AM
yeah, my current job offers no severance and doesn't even pay you for unused vacation time (of which I have about 160 hours)if I ever got let go, I would be screwed.
7/2/2008 11:00:55 AM
7/2/2008 11:01:10 AM
wait, the mods get paid?
7/2/2008 11:02:27 AM
7/2/2008 11:03:08 AM
obviously not
7/2/2008 11:04:14 AM
I had PTO at this job, and was actually negative with them for the rest of the year (used all my PTO for the year in the first 6 months). So I got them there, haha!
7/2/2008 11:04:52 AM
just because a company is doing it doesn't make it any less illegal.
7/2/2008 11:04:55 AM
Yeah I'm wondering if any of this is illegal.
7/2/2008 11:06:21 AM
c'mon pookie, lets burn this motha fucka down!
7/2/2008 11:07:28 AM
you need us to go "visit" them?
7/2/2008 11:07:49 AM
I feel for ya Teg... sorry that happened, did they say why they didn't need u
7/2/2008 11:08:48 AM
7/2/2008 11:08:51 AM
Were you being paid during those three weeks you weren't doing anything productive for them?Economic conditions are brutal out there, so it's probably just an unfortunate coincidence that they had to lay you off after having just been off for weeks due to injury. Were you the only one let go of how ever many are in your office or were other people let go as well?
7/2/2008 11:10:48 AM
I was the only one let go, I think. (was only in the office for 90 minutes after 3 weeks out, definitely only one from my department). The economy isn't that bad up here. NYC usually bucks the trend. As far as being paid, the way my short term disability package worked I recieved no pay for the first 8 days and then began disability on the 9th day. I was out 3 weeks so thats only 7 business days of being paid. I don't have this money yet. I'll probably get it in 2 weeks or so. Which blows b/c due to a lot of medical expenses I only have like $100 in my checking account right now.[Edited on July 2, 2008 at 11:13 AM. Reason : k]

7/2/2008 11:11:57 AM
Hmmm that poses a good question!I'm in the negative for my PTO, and I'm hardcore job hunting. Does that mean when I quit, I won't lose pay for the negative hours?
7/2/2008 11:12:02 AM
^^Why can't a company just fire someone today?They shouldn't owe you shit.And just because they didn't give him a reason doesn't mean there is no reason.[Edited on July 2, 2008 at 11:13 AM. Reason : ]
7/2/2008 11:13:19 AM
^^ I think it depends on the company, but I'm sure they can just deduct it from your final check.
7/2/2008 11:14:15 AM
They didn't give me a real reason. I've worked there almost 3 years and had the 2nd highest seniority at my position.
7/2/2008 11:15:56 AM
damn...does this mean you may not be in NYC when Justin and I come up August 7-10th??
7/2/2008 11:16:00 AM
Each state has it's own policy regarding firing people. NC is a "no fault" state, but I have no clue about NY.Well damnit, I hope I am not negative by too many hours.
7/2/2008 11:16:13 AM
oh sweet!my man servant will be here sooner than i thought....Pat...you've got to stop letting this happen to you
7/2/2008 11:17:13 AM
^^^Sadly it does. I'm only paying rent till the end of the month up here. After that I'll either have a job in Raleigh (hopefully) or crashing at my parents in Charlotte and looking for a job in Raleigh^hahah, I know right![Edited on July 2, 2008 at 11:18 AM. Reason : k]
7/2/2008 11:17:32 AM
damn b that sucks man. i dont know what the goberment is like up there but they would have to start paying me to live there. sit back and collecton that shit
7/2/2008 11:17:39 AM
damn man, that sucks come back to raleigh[Edited on July 2, 2008 at 11:19 AM. Reason : af]
7/2/2008 11:19:28 AM
7/2/2008 11:20:09 AM
^no problem at all. There are 6 other people in the department with the same position as me. Hope that helps. Well, its definitely illegal to fire someone for being out for a medical reason. I have plenty of documentation from my surgeon. Fuck I have a 4 inch scar on my knee, what else do they need?I'd only talk to a lawyer if it was a free consultation and if they'd only charge me if I won.[Edited on July 2, 2008 at 11:23 AM. 7/2/2008 11:21:41 AM
DAMNIT!!! oh well...well then, we would like a list of bars that Justin can drink "NYC cheap" PBR and a preemptive "Welcome Back to Raleigh" to ya [Edited on July 2, 2008 at 11:22 AM. Reason : ]
7/2/2008 11:22:15 AM
Sorry LK, but I'll do what I can to get a list of cheap bars for ya (thats mostly where I go anyway)
7/2/2008 11:24:30 AM
7/2/2008 11:26:27 AM

7/2/2008 11:27:02 AM

cockgobblers!
7/2/2008 11:55:47 AM
that sucks isn't this the second time you've got "let go"?you got me beat by onehopefully i can mooch off this company as much as i can until they figure out i'm worthless
7/2/2008 11:58:56 AM
damn Pat, sorry to hear about this man. ive been there. you can always apply for unemployment benefits. good luck with it all. shitty way to start a holiday
7/2/2008 12:24:18 PM
Shitty man, sorry to hear. Maybe it's a sign that you were supposed to move back to NC. God just wanted you to hurry the fuck up. Good luck with the job search and physical therapy.
7/2/2008 1:28:29 PM
Thanks guys. Its cool, this isn't gonna put a damper on my holiday. I wanted to move back to NC anyway, and now my company letting me go made it a lot easier. Not easier financially, but all in all its okay. Just right after returning from medical leave is pretty fucked up.I am a little worried about my physical therapy though. If I have to get new insurance, aren't they likely not to cover a pre-existing condition?[Edited on July 2, 2008 at 1:30 PM. Reason : k]
7/2/2008 1:29:30 PM
as long as you were last covered in the previous 30 days you're good might need some bcbs for a couple months if your job search doesn't yield immediate results they probably made the decision to cut an employee while you were gone. since you weren't there, it was easier to pick you.
7/2/2008 1:38:37 PM
i got fired cause of my hand preventing me from working as well. i'm still jobhunting atm
7/2/2008 1:40:02 PM
^^ yeah. Absence makes the heart grow fonder, but not in the job world. They probably figured if they could survive without you for three weeks, they could do so in the long run, and save money. Also, don't put it past the other people in your department to angle for promotion or whisper in the boss' ear while you were gone.I would definitely look into that insurance thing very carefully.[Edited on July 2, 2008 at 1:44 PM.
