i think that if i drank a beer and went through a checkpoint and i knew i was below the legal limit i'd still refuse to blow at the checkpoint just on principle. but that would just end up ruining my night. i guess it would depend on the plans. if i had nothing better to do, it seems like a good experiment.

Yeah, it pisses me off. But the reasoning behind it is that driving is apparently considered a privilege, not a right, and when you get your license you agree to submit to any sobriety tests. Therefore, refusal results in violation of contract and therefore termination of your license. That is my understanding, anyway.

I thought the breathlyzer wasn't able to be used in court. I thought they had to use the one in the station? There is now way that if you refuse to blow you lose your license for a year. That seems a bit far out there.

I'm pretty sure it applies to all. But I do know that the breathalyzers they have on scene aren't enough to convict, so you blow there, they take you down to the station where you blow again, and that can be used in court. But, if its a number you don't like, you have the right to demand a blood test (if one wasn't already administered) at your own expense. It takes some time for them to set that up if your in a small town, so that gives you more time to sober up. Dunno what its like in raleigh though

I always carry a shit load of doritos in my car so they can't smell the alcohol in my breath.that way i'm free through the checkpoint and can hit innocent people. OK so maybe your automatically arrested (or detained) for refusing to blow. That actually seems like it might be right, then if you refuse to blow at the station, its an automatic suspension.
