my bf got pulled out of the car at a checkpoint on holly springs a few weeks ago. we'd been drinking earlier in the night at my dad's 60th bday (not excessively obviously). it was TRES scary. he blew under the limit (obviously) but it was still terrifying.

i think that if i drank a beer and went through a checkpoint and i knew i was below the legal limit i'd still refuse to blow at the checkpoint just on principle. but that would just end up ruining my night. i guess it would depend on the plans. if i had nothing better to do, it seems like a good experiment.

If you refuse to blow you automatically lose your license for a year. I like hassling them just as much as the next guy, but I will admit that my principles aren't strong enough to support me losing my license.

Yeah, it pisses me off. But the reasoning behind it is that driving is apparently considered a privilege, not a right, and when you get your license you agree to submit to any sobriety tests. Therefore, refusal results in violation of contract and therefore termination of your license. That is my understanding, anyway.

I thought the breathlyzer wasn't able to be used in court. I thought they had to use the one in the station? There is now way that if you refuse to blow you lose your license for a year. That seems a bit far out there.

Um, yes, it is a privilege. There's a reason why you have to get A LICENSE. People that aren't qualified or responsible or safe do not get to have the privilege.

I'm pretty sure it applies to all. But I do know that the breathalyzers they have on scene aren't enough to convict, so you blow there, they take you down to the station where you blow again, and that can be used in court. But, if its a number you don't like, you have the right to demand a blood test (if one wasn't already administered) at your own expense. It takes some time for them to set that up if your in a small town, so that gives you more time to sober up. Dunno what its like in raleigh though

I always carry a shit load of doritos in my car so they can't smell the alcohol in my breath.

that way i'm free through the checkpoint and can hit innocent people. Besides drunk drivers never get hurt in accidents. I don't care if some kid loses his legs

implied consent refers to "the one in the station"; the handheld job is just to get probable cause to arrest you; refusing to blow at the station will cause you to lose your license for a year, but you can apply to have it reinstated after 6 months

implied consent only kicks in after you've been arrested, the field tests are used to establish probable cause for arrest

OK so maybe your automatically arrested (or detained) for refusing to blow. That actually seems like it might be right, then if you refuse to blow at the station, its an automatic suspension. Damn .001% of me not being sure.
