Scenario:

Let's say that I have my own insured car but decide to drive a friend's car and then get into a wreck that was my fault...

In this situation, what happens in terms of insurance coverage? Will his insurance cover me or would my insurance cover damages?

I want to make sure that he would not be liable should I get into an accident.

Thoughts?

it depends on his and your policy, but he is likely liable

just don't do it if you aren't sure who has to pay for it later

For the sake of clarity, YOU are liable, but more than likely covered under his policy. Any damages not covered under his policy are your liability.

i would sue you... because either way you're fucking him.


if his insurance covers it, his rates go up.

if your insurance covers it, he has to go through the bullshit of waiting for everything to settle.

some policies will cover you no matter what vehicle you are driving, i.e. a rental car.

Why would you have 2 copies of your insurance card (one for your car, and one for your wallet) if your policy didn't at least partially cover you in another vehicle?

you could always just ask your insurance company. I've got Geico full coverage, and my liability coverage follows me regardless of what vehicle I am driving. They only cover collision, however, in my vehicle.

Correct.

While your policy may cover you in a rental car, if someone else wrecks your car, YOUR insurance pays, not his.

this exact situation happened to me in 2004.

it was the last weekend in february, and raleigh had just gotten a shit ton of snow on thursday night. then it got up to like 70 degrees on friday and everything melted, subsequently freezing over on friday night. my best friend was driving another good friend's Explorer. we were coming home from Stool Pigeons. we took a left turn from Glenwood onto Lynn Rd, the Explorer spun out on black ice, and she wrecked the vehicle into the entrance wall of an apartment complex. the truck was totaled, and unfortunately, my friend didn't have GAP insurance and ended up owing about $4k on the truck above what it was worth. my best friend wasn't liable for a penny. their relationship was ruined after that.

long story short - the insurance follows the vehicle. at least it did in 2004 in Wake County
