and that's just as the plaintiff. at least for the most part, I'm not the one on the receiving end of the long dick of the law.

Over the last few years, I've gone to court twice with my ex regarding my daughter, and to mediation another time. I've spent $10,500+ in legal expenses on the matter, and I'm sure that figure is just the start. Just tonight, I had to send yet another email to my lawyer, as my ex has ignored all 10 of my attempts over the last 2 weeks to get an answer about what dates my upcoming visitation will be (hell, even if she said "no" to what I proposed, that would be a start, as then we could start talking about alternate plans).

...and if that isn't enough, I plan on sending in the paperwork tomorrow to file a small-claims lawsuit against my former roommate, who left owing me $2100 in rent (bad checks), and who did a few hundred dollars worth of damage to my stairwell when moving his furniture out. I printed the stuff out today and got an estimate from a painter, but ran out of time to fill it all out and send it in.

Why in the hell can't people just act like responsible, reasonable adults and do things the right way without getting their bells rung in court to force it?

Do you actually have any proof that your agreement with him was anything other than month to month?

I can't recall from the other thread.

^^^ no, it WAS month to month. I have 2 bad checks to hold him accountable with, though, and the last month, he just didn't pay (then moved out unannounced while I was gone). I also have a handwritten payment schedule (that he wrote), detailing what he owed me and when he intended to pay.

^^ yeah, i totally agree, although that still doesn't make me understand why people can't fucking act right.

...and I don't see how my ex could possibly think that I would roll over and take anything.

^^^ oh, man, i have a vigilante streak a mile wide. i personally would have no qualms with it, and it would take care of matters a whole lot more quickly, easily, cheaply (and probably more effectively) than the legal avenues...there are a couple people who would without a doubt be dead, and some more who would learn some lessons in fashions they wouldn't be quick to forget.

unfortunately, it would eventually cause me more trouble than it was worth to handle things that way.

Why don't you ask yourself? I seem to remember you bragging about how you considered getting tickets and going to court for them as a "fee" that you pay in order to speed and drive recklessly.

Perhaps the people on the road whose lives you're endangering would wonder why you can't act like a responsible adult without getting your bells rung in court. Perhaps your baby mama considers the legal crap you're throwing at her an acceptable trade for keeping you away from her daughter.

Perhaps you're experiencing a healthy dose of karma.

I speed. I don't drive recklessly, endangering other people. I'm more concerned with what a proper speed for the given circumstance is than whatever borderline arbitrary number is posted on some little white sign. There have been times (torrential downpours, etc) where I was getting passed on the highway by most of the other traffic. At other times, on a sunny, dry day with no traffic, driving my sports car, there isn't a thing in the world wrong with me driving at speeds that would get me a ticket if caught. I'm not advocating doing 150 through a school zone.

That's a terrible analogy--me speeding is not comparable to what these two dumbasses have done, and I maintain that a significant portion of traffic enforcement is a racket, anyway.

Besides that, nowhere did I say "Why in the hell can't people follow all the rules and laws?" In fact, I think that my position has always been pretty consistant, that--at least sometimes--there is a distinction between what's right and what's legal.

and finally, i've never detailed on here every crazy, fucked-up thing my ex has done. I assure you, she rates no advocacy. Additionally, she is completely irrational and, in my opinion, probably suffers from some untreated mental disorder(s). She did all sorts of crazy shit (to include suing me and denying me visitation) while at the same time BEGGING for me to marry her. It's not a calculated decision on her part to keep me away from my daughter for her benefit, no matter what the cost. I don't think anyone, including her, can really explain her actions, but that isn't what's going on here.

So, to summarize this thread thus far. You think its ok for you to break the law because you have good reasons for it. Anyone else is being irresponsible and they don't have good reasons.

Does that sound about right?

are you seriously comparing, say, 75 in a 55 on some empty backroad, in a high performance car, to perjury, contempt of court, hiding my daughter from me the day before I moved across the country, not answering the phone or emails for 2 months while I was in Iraq, letting me drive all the way to FL when I got home from Iraq to pick up my daughter for a couple of weeks (as she agreed to), then refusing once I got there, and otherwise trying to keep a little girl away from her daddy?

I've won EVERY single thing I've contested in both instances of court AND mediation. I assure you that if there was any legitimate reason for what she was doing, she would've pleaded her case to the judges.

You know what her arguments have been? The first time, it was a fabricated medical condition (long story...I assure you that it was completely made up). The second time, she argued that I shouldn't have visitation because I'd never had visitation...when the whole reason for that was because she kept on ignoring the court order.

[Edited on January 13, 2010 at 12:24 AM. Reason : not to mention the time she drunk-dialed me while driving with our daughter]

You are willing to accept the consequences of speeding and you have made the decision that flouting traffic safety laws is worth the penalty.

Your baby mama has probably made a very similar decision.

But of course, its totally different in this case, largely because it negatively affects you. Its a funny thing - laws are in place for the benefit of all of society. When you start picking and choosing them, people get hurt. Now, this is the first time you've been on the other end of such a calculation and you're acting all butt hurt. Well, maybe you should learn something from this instead.

no, it's not the first time i've been on the end of such a calculation, and no, i'm not sure I'd describe my ex's actions as "calculations" to begin with in many cases. They seem to be more along the lines of impulsive reactions, most of the time.

I think I know what this latest round is about...she's pissed that I let our 3 year old stay up until 9pm (instead of putting her to bed at 7pm like she does). That, and I don't make her address me as "sir". I'm quite content to be "daddy". Oh, and God forbid that I lay down with her and read to her for 10 minutes when I put her to bed...that's a bad precedent to set: mommy "doesn't have time for that", being busier than I can imagine as a secretary, working 40-hour weeks.

and in my 15 years of legal driving, my speeding has never harmed anyone. I maintain that I (by virtue of knowing what I'm doing and paying attention while driving)--in a high performance car (that has far superior turning and braking ability to what most people are driving), am much less of a risk doing 20-over than the vast majority of people are while doing 8-10 over.

Furthermore, 99% of the people on the road speed almost all the time. I just do it by a somewhat wider margin than most do. I don't really see what the difference is if you're trying to be all legal eagle about it.

Look, if you really want to appeal to the law, I'll just say that the law has sided with me in every instance regarding my ex. I feel like this roommate case should be totally one-sided (although I don't know if I'll actually get the money out of him...at a minimum, I should be able to totally shitcan his credit, though). I think I even have a clean driving record (I might have one ticket for 9-over that hasn't gone away yet).

I mean, the scofflaw argument is, ummm, an interesting way to make a case against me.

Of course, the reality is that you're just trolling, like usual. I was going along with it up until this point, but now I'm ready to call it a night.

That's kind of my point. If she wasn't in the wrong, the situations wouldn't be comparable. You're flouting the law by speeding - she's flouting the law by keeping you from her kid. You both have good reasons for it, you're both in the wrong but are willing to deal with the consequences.

such is life.

the point is, they're both ok with the legal consequences of their decisions and have decided that it is worth it to continue flouting the law. They both have good reasons for it, they're both in the wrong but are willing to deal with the consequences.

Even I don't agree with Duke's rationalization for speeding or his disregard for the laws, but what this bitch is putting him through is not the same thing.

What boggles my mind actually is how Duke even got involved with her. He seems too smart for that and should have seen her level of crazy a mile away. No offense dude.
