senate already did something.

nothing more is needed.

obama will sign bill very soon and it will be the law of the land.

if the senate chooses to improve the new law, that would be good but totally unnecessary.

U.S. Constitution...Article 1, Section 8:

Quote :
"The Congress shall have power To lay and collect taxes, duties, imposts and excises, to pay the debts and provide for the common defence and general welfare of the United States; but all duties, imposts and excises shall be uniform throughout the United States;
To borrow money on the credit of the United States;
To regulate commerce with foreign nations, and among the several states, and with the Indian tribes;
To establish a uniform rule of naturalization, and uniform laws on the subject of bankruptcies throughout the United States;
To coin money, regulate the value thereof, and of foreign coin, and fix the standard of weights and measures;
To provide for the punishment of counterfeiting the securities and current coin of the United States;
To establish post offices and post roads;
To promote the progress of science and useful arts, by securing for limited times to authors and inventors the exclusive right to their respective writings and discoveries;
To constitute tribunals inferior to the Supreme Court;
To define and punish piracies and felonies committed on the high seas, and offenses against the law of nations;
To declare war, grant letters of marque and reprisal, and make rules concerning captures on land and water;
To raise and support armies, but no appropriation of money to that use shall be for a longer term than two years;
To provide and maintain a navy;
To make rules for the government and regulation of the land and naval forces;
To provide for calling forth the militia to execute the laws of the union, suppress insurrections and repel invasions;
To provide for organizing, arming, and disciplining, the militia, and for governing such part of them as may be employed in the service of the United States, reserving to the states respectively, the appointment of the officers, and the authority of training the militia according to the discipline prescribed by Congress;
To exercise exclusive legislation in all cases whatsoever, over such District (not exceeding ten miles square) as may, by cession of particular states, and the acceptance of Congress, become the seat of the government of the United States, and to exercise like authority over all places purchased by the consent of the legislature of the state in which the same shall be, for the erection of forts, magazines, arsenals, dockyards, and other needful buildings;—And
To make all laws which shall be necessary and proper for carrying into execution the foregoing powers, and all other powers vested by this Constitution in the government of the United States, or in any department or officer thereof."

and then just in case that wasn't clear enough, we have the 10th Amendment...redundant, but, you know, just to make sure...

Quote :
"The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people."

...and yet we STILL don't even come CLOSE to following the supreme law of the land.

Once a district becomes dependent on something, it’s hard to change things. It’s one of the reasons cutting defense spending is so difficult (because some places depend on those jobs), and why people bitched so much with privatizing space travel (because people also depended on those jobs).

This is going to be hard to completely eliminate. I just hope the benefits are worth it, and we can still find ways to actually start paying down the debt like Clinton did.

Hell yeah. Hopefully the fine for not being insured stays cheaper than actually buying insurance. I'll just wait til something bad happens, then get insurance. Now we need home and auto insurance legislation too. If I'm uninsured and I total my car, why should I have to buy a new one? It should be free. If my house burns down and I don't have home owner's insurance, I should be able to get insurance after the fact, and then get a free new house. This is America god damn it.

Dude, no one gives a shit about the constitution. We might as well just trash it at this point, because congress is going to do whatever gets them back in office.

^^ it’s already mandatory to have auto insurance if you have a car, and most mortgages (maybe all) require home owners insurance.

I am not sure how I feel about all of this.

My husband and I fared far better for having private insurance over government funded insurance as far as our son is concerned. All children who are born with a disability qualify for Medcaid for the first 12 months of their life without regard to their parent's income. Our plan with UHC through my husband's job approved Silas's experimental thymus transplant and paid for most of the costs. Many other children (those with only Medicaid or those who were under insured) died waiting for approval or for their families to raise enough money to pay for the costs associated with transplant (100s of thousands of $). I am glad that we had our group plan. With a handicapped child, I'm finding out every day that government plans (be it Medicaid or Early Intervention Services, etc.) are far better than no plan, but they're fairly inflexible and bogged down. If it's not on some pre-approved list, it takes an act of Congress to receive help.

sorry you're just validating duke's stance. that's only state by state.

like tennessee - you don't have to have vehicle insurance. well you didn't when i lived there.

Haha well that's not how I meant it. I meant it in the fact that I already have a few pre-existing conditions. And I am going to lose my health care from my mom at the end of this school year, and depending on if I find a job that offers benefits like health care while I finish up my schooling I will be without health insurance. I will like the fact that there will be something in place in which I will not be denied health insurance once I try to get it again because I had to be dropped.

[NO]

That's not the way it works. I mean, yes, it theoretically could be repealed, but that's not the way programs like this work. They are forever, no matter how fucked up they are. Social Security is probably the #1 example.

Abortion is just a footnote in this.

I wouldn't have the constitutionality issue with it in principle, no.

I mean, I wouldn't want my state to enact this, but I have no problem with the fact that Massachusetts more or less did. Whatever, if that's what they want...I wouldn't be subject to it or required to pay for it, so go for it.

I'll just move it back to Chit Chat. There's already a thread on this there. Maybe it will be good for people who don't normally venture to the Soap Box to read some of this.
