yep
1/21/2012 9:47:21 PM
if she wants to sue, sue the city/train stationits still a bullshit lawsuit, but if you win at least its govt money and not some grieving family
1/21/2012 9:57:16 PM
I mean, it was reasonably foreseeable...he shouldn't have ran across the track. When you run in front of a train, you run the risk of getting hit. If you get hit by a fast moving train, it can tear your body apart. Flying chunks of bone and meat hurt. They've been known to bring down airplanes. All of these are foreseeable. And its reasonably foreseeable because the vast majority/all of us had the dangers of crossing shit like roads and train tracks instilled to us by our parents as children. And just using what little I know of tww parents as a guide, my guess is the vast majority/all of their children will also be taught the same dangers. Stupidity becomes negligence when an innocent bystander gets hurt...The lesson here is don't be a fucktard because it can kill you and get your grave spit upon.

If he hadn't died, he would have been held liable for at least her medical bills.
1/21/2012 10:13:49 PM
1/21/2012 10:27:33 PM
It's his fault. He should be sued.
1/21/2012 10:46:12 PM
why not sue the train station or city/county? i thought all the douchebags that cry wolf lawsuit all the time also hated the government and corporations too? especially if you're cash savvy, you gotta figure a municipality or corporation will have more money to give in a lawsuit than some non-rich individualand i doubt corporate lawyer advantages would come into play since i'm sure there would be plenty of lawyers willing to take it on pro bono
1/21/2012 10:54:16 PM
Yeah I'm sorry that your son was a dumbfuck and died but why should I have to pay for the injuries sustained by his actions?Just because it's depressing doesn't make him (or his estate) any less liable.
1/21/2012 11:03:12 PM
its not like he robbed a bank and some innocents got shot...its not like he was even trying to commit suicideif he got hit by a car instead of a train, and his skull busted my headlight, should i sue his estate for a new headlight]
1/21/2012 11:05:02 PM
your analogy is baseless sir.

1/21/2012 11:14:16 PM
1/21/2012 11:20:15 PM
i'd sue Amtrak for creating trains that create unsafe environments for future passengersand this happened in Chicago, so again i reiterate, i could find a scumbag lawyer pro bono to sue the city just like this lady is finding a scumbag lawyer to sue a dead guy whose actions had no malicious intent whatsoever^IRL, Geico would pay for my headlight repair assuming I didn't run a red light or something...health insurance is a different animal though[Edited on January 21, 2012 at 11:22 PM. 1/21/2012 11:20:55 PM
getting drunk as fuck and choosing to drive arguably has no malicious intent, but there are still consequences.[Edited on January 21, 2012 at 11:49 PM. Reason : can't tell if trolling...]
1/21/2012 11:48:03 PM
the judge should rule in her favorand garnish the boy's future wages as repayment
1/22/2012 2:41:34 AM
^ I'll allow it.
1/22/2012 7:46:10 AM
^^haha, that would be such a slap in the face and would never happen, but would be so epic
1/22/2012 7:50:26 AM
1/22/2012 10:58:38 AM
sued4losing sounds like a band name.
1/22/2012 11:02:58 AM
I thought it sounded like some kind of sleazy companyLike Cash4Gold but even worse.
1/22/2012 11:43:04 AM
ah, it would be a good personal injury lawyer's office

1/22/2012 12:18:30 PM
what the fuck is this woman expecting to get from the "estate" of an 18-year-old? his XBox360?
1/22/2012 12:30:41 PM
They're probably hoping the parents have some sort of umbrella insurance policy on him that they can draw from. If he was still a dependent they were probably carrying car insurance and health insurance on him, so an umbrella policy is not far fetched.[Edited on January 22, 2012 at 12:38 PM. Reason : s]

1/22/2012 12:40:37 PM
it was a dude in chicago. dumb enough to run across the train tracks at a train station. what in the flying fuck makes you think that kid's parents showed any other aspect of responsibility such that there would be money saved up or available in any fashion.
1/22/2012 1:16:45 PM
1/22/2012 1:24:29 PM
that they got from taxpayers
1/22/2012 1:25:15 PM
and gangbangers and mafiabetter it pay some lady's medical bills, than buy Blagojevich a new car]
1/22/2012 1:26:02 PM
and taxpayers. you think the city would pay money from the politician's pockets? come on
1/22/2012 1:26:43 PM
When you got plenty of money, you can afford to be graceful and tactful about these kinda things. But if you're hurt, you're hurt; and if you don't have extra money to pay surprise hit-by-flying-body-parts bills, then you have to sue.[Edited on January 22, 2012 at 2:03 PM. Reason : sucks]

Maybe it's just me, but I see nothing wrong with suing the estate. His stupidity got him killed and injured another person. That 58 year old woman isn't responsible for her injuries, that 18 year old was. His estate should pay for cost of doctors visits as well as some pain and suffering.
1/22/2012 2:34:50 PM
^agreed.
1/22/2012 2:35:38 PM
again. what estate does an 18-year-old boy have? his math homework?
1/22/2012 2:37:03 PM
should probably look up the definition of estateI'm Krallum and I approved this message.
1/22/2012 2:37:49 PM
really looking forward to getting his MP3 player
1/22/2012 2:38:21 PM
I'm sure the family is gonna be getting something from the train station even if it was the kid's fault. That's where her money should come from.
1/22/2012 3:06:23 PM
and that money still wouldn't be part of the KID'S estate, would it?
1/22/2012 3:07:16 PM
^^i can agree with that whollylook i agree the lady got her leg broken and it wasnt her fault, it was the kids fault...but the kid has already been punished by death by train...hasnt he paid enough?]
1/22/2012 3:08:06 PM
1/22/2012 3:11:14 PM
^^^ Unless the money goes to his estate, which would then go to his parents. Also even as a legal adult he was likely still a dependent.
1/22/2012 3:12:40 PM
^^i think its a bullshit lawsuit period, said so in my first postyou guys keep acting like its the kids' parents' direct fault[Edited on January 22, 2012 at 3:14 PM. Reason : .]

1/22/2012 3:14:51 PM
None of us know what kind of money this kid's family has. We don't even know if he was still legally a dependent. He could have nothing or he could have made a sizable chunk of cash making a porn app for Android. I'm sure the lawyers she hired figured out that he had enough of an estate to go after or else they wouldn't be wasting their time.
1/22/2012 3:17:26 PM
yes we do. he was a kid in chicago who was dumb enough to run across train tracks at a train station. people that stupid don't have money
