What that article doesn't say that the video has is that once he was down from the head hit, she started hitting him in the feet and ankles so that he couldn't leave before the cops got there. Now he has a broken ankle.Also, when the guy got into the house, the woman was in the back about to get in the shower while the kids were in the front. He told them to keep quiet while he went back to get to the mom.So, isn't her pursuit of the guy illegal or something? Is that just limited to shooting intruders, or did that change with the new laws

That's my understanding. You can use an appropriate amount of force to stop an attack, but once the attack is stopped it becomes assault if you keep pummeling them.I doubt they'll bring charges against her, but he probably has a good lawsuit if he decides to pursue it.

Nope, not if she's got a legitimate fear for her safety. And I would, if I thought he might wake up before the cops got there. How many times in those horror movies do the victims let the murderer go because they think he's dead, only to get stabbed later. He's still in her house, she can neutralize the threat all she wants.

You don't have to cite those horror stories, the jury has that in their head. All you have to do is convince people that you were genuinely afraid. Get a bunch of people on that panel who are afraid of home break ins, robberies, and put a big scary guy in the attacker's seat, and it's a slam dunk.

^^ I agree and I wouldn't want her to be charged. Still, people need to think about their actions in situations like this and they need to be especially mindful of their words after the incident.She had all the right in the world to shoot him when he came into her house, but you can't legally assault someone once they are no longer a threat. If she really wanted to ensure the safety of her family she would have taken her kids to a safer location when she knocked him out.She gave him a well-deserved ass whooping, but that doesn't make it legal.
